1. Acceptance of Terms

By accessing or using Jenny AI ("The Wizard Intelligence Engine"), operated by Mason Alexandra Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Intellectual Property Rights

PROPRIETARY TECHNOLOGY NOTICE

All software, algorithms, methodologies, and technology comprising "The Wizard Intelligence Engine™" are proprietary to Mason Alexandra Ltd and are protected by copyright, trade secret law, and international intellectual property treaties.

Our proprietary systems include but are not limited to:

  • The Wizard Intelligence Engine™ - AI conversation and optimization system
  • Dynamic Behavioral Optimization Protocol (DBOP)™
  • Adaptive Lead Scoring System (ALSS)™
  • Multi-Context Prompt Assembly System
  • Self-Calibrating Machine Learning Algorithms
  • Message Batching and Buffer Management System
  • Predictive Conversion Intelligence

All trademarks, service marks, trade names, and logos displayed on the Service are the property of Mason Alexandra Ltd.

3. Confidentiality Obligations

You acknowledge that through your use of the Service, you may be exposed to confidential information including:

  • Technical specifications, algorithms, and system architectures
  • Business methodologies and operational processes
  • Pricing strategies and commercial terms
  • Product roadmaps and development plans

You agree to maintain the confidentiality of such information and not disclose it to any third party without our prior written consent.

4. Prohibited Activities

STRICTLY PROHIBITED

You expressly agree NOT to:

  • Copy, reproduce, or duplicate any part of the Service or its underlying technology
  • Reverse engineer, decompile, disassemble, or attempt to derive source code
  • Modify, adapt, translate, or create derivative works
  • Use the Service to build, train, or improve a competing product or service
  • Share account credentials or provide unauthorized access to third parties
  • Extract, scrape, or harvest data from the Service using automated means
  • Remove, obscure, or alter any proprietary notices or branding
  • Sublicense, sell, resell, transfer, or assign your rights to the Service
  • Use the Service in violation of any applicable law or regulation
  • Send spam, unsolicited messages, or violate Meta/WhatsApp policies

5. Description of Service

Jenny AI provides AI-powered sales automation services including:

  • Automated lead follow-up and qualification via WhatsApp
  • AI-driven conversation management and optimization
  • Lead scoring and behavioral analytics
  • Stage-based playbook automation
  • Booking and payment link facilitation
  • Reporting, analytics, and business insights
  • Web chat widget integration

6. Account Responsibilities

You are responsible for:

  • Maintaining the security and confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your use complies with WhatsApp Business API policies
  • Obtaining all necessary consents from your leads and customers
  • The accuracy of information you provide to the Service
  • Complying with all applicable data protection laws (including UK GDPR)

7. Billing and Payments

  • Usage-based fees are charged according to your selected plan
  • Credits must be maintained for messaging and AI services
  • Fees are non-refundable unless otherwise expressly stated
  • We may modify pricing with 30 days written notice
  • Failure to maintain sufficient credits may result in service suspension

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated responses may contain errors and should be reviewed before critical decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MASON ALEXANDRA LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mason Alexandra Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service immediately and without notice for violation of these Terms, non-payment, or any conduct we deem harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. Provisions relating to intellectual property, confidentiality, limitation of liability, and indemnification shall survive termination.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
